I do think Glenn is wrong on one thing – not a point of law – I wouldnever argue with him on that. But he says “taking away people’s Constitutional rights is not a winning strategy.” On the contrary, it was a winning strategy for Democrats until Lyndon Johnson renounced it, and it has been a winning strategy for Republicans ever since.

  2. JM: I’m still unclear about some aspects of this law. As far as I understand it, a doctor is in breach of this new abortion law when he aborts a fetus with a heartbeat. This is in itself utterly ridiculous. But people, interpreting the part of the law which requires fine upstanding citizens to sue anyone in relation to this abortion, then always talk about abortion in general. However, shouldn’t the snitch only be able to sue if it was a criminal abortion, i.e. after a heartbeat was detected? How would the snitch know that and how would they prove that in court? How would a snitch prove in court that that particular abortion had taken place at all? How could an Uber driver possibly know that he’s driving a woman to a clinic to have a fetus with a heartbeat aborted? It makes absolutely no sense at all. To me, most of it is just scare tactics to drive all clinics out of business.
    The really devastating part of the law is the heartbeat, which could start as early as 6 weeks after conception, before the woman may be aware she’s pregnant. That alone would prevent any doctor from doing most abortions in his clinic. I think this law was written with the intent to take it to SCOTUS and have everything else but the heartbeat part struck off, which is all that really counts.

    Sorry, I got on my high horse about this and now are running out of time before a meeting. Perhaps I’ll get back to commenting later on.

    • Since you brought up “fetal heartbeat,” perhaps you won’t mind if I rant a bit.  At “six weeks”, the former zygote is not yet even a fetus, and will not be one for AT LEAST two more weeks.  It is merely an embryo.  Now, empbryos, like zygotes, do not have hearts.  They are not sufficiently developed to have hearts.  What they can hear coming from the embryo is a succession of electrical pulses.  It is not a heartbeat.  No heart, no heartbeat.   In other words, the law is founded on a demonstrable lie.  I’m sure this is no surprise to you, knowing Republicans as you (and as I) do.  But I thought at some point it needed to be said.

      Incidentally, I verified those terms and numbers with Brittanica.  But they can be found anywhere the topic is scientifically discussed.
