I’m feeling a bit better, here in the CatBox, but I’m still quite tired, so I’ll be brief.  Tomorrow is a holy day in the Church of the Ellipsoid Orb.  My Broncos are meditating with the Colts, but it won’t be televised here.  I fear my full grown horses may be too long in the tooth to keep up with the kids.  May the Divine Orb shine its blessing light on your team, unless they are equine juveniles.  WWWendy also comes tomorrow to destink the foul TomCat and help with chores.  We have lots to do, so please expect no more than a Personal Update tomorrow.

From NY Times: A federal judge handed a victory to House Democrats on Friday when she ruled that they were legally engaged in an impeachment inquiry, a decision that undercut President Trump’s arguments that the investigation is a sham.

The declaration came in a 75-page opinion by Chief Judge Beryl A. Howell of the Federal District Court in Washington. She ruled that the House Judiciary Committee was entitled to view secret grand jury evidence gathered by the special counsel, Robert S. Mueller III.

Typically, Congress has no right to view such evidence. But in 1974, the courts permitted lawmakers to see such materials as they weighed whether to impeach President Richard M. Nixon. The House is now immersed in the same process focused on Mr. Trump, Judge Howell ruled, and that easily outweighs any need to keep the information secret from lawmakers.

Wonderful!  However, I have no doubt that Barrf will appeal this to the District Court of Appeals in DC, and upon losing there, to SCROTUS (Republican anti-Constitutional VD). This decision invalidates the entire noncooperation policy of the Republican Reich, but don’t expect any documents anytime soon. RESIST!!

    Elijah – Yes indeed. While still in tears, I do like the oh-so-gentle and oh-so-accurate shade cast by Hillary and Barack.

    Cartoon: Both The Netherlands and Australia are still waiting for them to be delivered while trying to get the money together for the ever-increasing costs.

    NYT: Another win for House Democrats, which is positive, but -as you say, TomCat – but no guaranty that this will deliver the desired results. For that to happen, Barrf will need to be impeached immediately.

    MSNBC: A reminder of why I respected this man so much and to why his presence on Congress will be very much missed.

    YT: I know the song, but in an only slightly rowdier cover version by the Dave Clark Five from the UK in 1970.

  8. Judge Howell’s 75-page ruling is a HUGE win for Democrats and democracy!

    Although written by a law professor, this explains in understandable language the impact of the ruling:

    The court ruled for the Committee. The court first concluded that a Senate impeachment trial is “a judicial proceeding.” The court said that the phrase “judicial proceeding” has a broad meaning; that an impeachment trial is inherently judicial in nature; that historical practice supports this reading; and that D.C. Circuit law “forecloses any conclusion other than that an impeachment trial is a ‘judicial proceeding.'” 

    The court next concluded that the Committee’s investigation is “preliminary to” that judicial proceeding. It held that the Committee’s “primary purpose is to determine whether to recommend articles of impeachment,” and that requiring anything more would result in the court impermissibly intruding on Congress’s Article I powers. 

    Notably, the court emphasized that the Committee’s work investigating impeachment is legitimate and constitutionally permissible, and that nothing requires the House to adopt an “impeachment inquiry resolution” to legitimate its work.

    Undoubtedly it will be appealed, but she obviously wrote it with that in mind – it’s a very solidly written ruling.
