I’m not sure if Rep. Jerry Nadler’s [D-NY] tactic will work, but if it does, it’s a stroke of genius.  This is not a formal impeachment inquiry.  They are investigating whether or not to open a formal impeachment inquiry.  To the best of my knowledge, Speaker Pelosi [D-CA] has not softened her opposition to impeachment.

The House Judiciary Committee on Friday asked a federal judge to unseal grand jury secrets related to Robert S. Mueller III’s investigation, using the court filing to declare that lawmakers have already in effect launched an impeachment investigation of President Trump.

In a legal maneuver that carries significant political overtones, the committee told a judge that it needs access to the grand jury evidence collected by Mr. Mueller as special counsel — such as witness testimony — because it is “investigating whether to recommend articles of impeachment” against the president.

“Because Department of Justice policies will not allow prosecution of a sitting president, the United States House of Representatives is the only institution of the federal government that can now hold President Trump accountable for these actions,” the filing told the judge, Beryl A. Howell, who supervised Mr. Mueller’s grand jury.

Referring to the part of the Constitution that gives Congress the power to impeach and remove a president, the filing continued: “To do so, the House must have access to all the relevant facts and consider whether to exercise all its full Article I powers, including a constitutional power of the utmost gravity — approval of articles of impeachment.”

With the filing, the committee’s chairman, Representative Jerrold Nadler of New York, was attempting to sidestep the debate raging inside the Democratic Party over whether the full House should hold a vote to formally declare that it is opening an impeachment inquiry. By declaring that his committee was in effect conducting such an inquiry, he was heading off a politically difficult vote in the committee or the full house to pursue impeachment…  [emphasis added]

Assuming that the judge grants Nadler’s request, I’m certain that Barrf will appeal, but at least the appeal will happen while Congress is on their summer recess.

If it goes to SCROTUS (Republican Anti-Constitutional VD), all bets are off.  At SCROTUS the Constitution takes a back seat to goose stepping with their Fuhrer.

Although an ongoing impeachment investigation is most beneficial,  I still think that passing actual articles of impeachment for Senate trial is a bad idea.  There is no chance to convict.  Also, cast not thy pearls before swine (see below).

  1. Like you, I don’t think Pelosi’s resistance has softened. However, she has come to the point of saying things which state or imply that, while it may be off the table now, there may come a time when it is on the table. I’m fine with that. I’m thrilled they are not going to be daunted from investigating. (The Mango Menace just tweeted to the effect that Elijah Cummings, his entire district, and probably the horse he rode in on are corrupt. He can’t possibly know who he is dissing – Cummings is not the only one who won’t stand for that, and he has a record well worth standing on.)

    Yo Dems, investigate away, dominate the news cycles, publish everything.

      Is it a true “Optical Illusion” – or am I just seeing things? (Not the first time.)

      • No, you’re not alone in this, Nameless. It has the same effect on me. 😵

      • Count me in that club!  I cannot remember the name for that effect but I studied it in physics in grade 11, a long, long time ago!  It is similar to car wheels that appear to be going backwards but the car is advancing forward.

      • I’m in the middle.  I see it sometimes, and then I don’t.  Sometimes it’s stronger.  I recently finally got frustrated to the point of changing my desktops to eliminate the shadow on the icon names, so maybe I am developing a little double vision myself, or maybe it’s just my astigmatism.

      • I predicted and expected strong and articulate pushback, including from the man himself (“Mr. President, I go home to my district daily. Each morning, I wake up, and I go and fight for my neighbors. It is my constitutional duty to conduct oversight of the Executive Branch.”). But it was AOC who touched me the most deeply: “Let me tell you a story about Chairman Cummings. Before new members are assigned to Congressional Committees, we have to make our case to the chair. Chairman Cummings was TOUGH. I sat down in his office to make my case for Oversight, and I was quite nervous. He looked right at me and said, “I am going to ask you plainlt. Are you here to do the work?” People’s lives are at stake in urgent ways on Oversight. He demanded excellence, & was watching my every word. I said, “Yes,” &made my best case incl why & how I wanted to be on the cmte. By the end of the mtg, I hade no idea if I made the cut. If you look at Oversight, it includes many all-stars of Congress. From [Jamie Raskin} to [Ro Khanna], Cummings is a legendary coaxh who brings the best out of everyone. He makes the country better. You want to be on his team.”

  3. I hope noting Nadler as a “R-NY” in the top line of your preface was not intentional because I changed it to     “D-NY”.

Well, I suppose impeachment is worth a try, but since Pelosi is playing stick-in-the-mud, and because the Rethuglican controlled Senate will stymie it, maybe Democrats should focus on winning in 2020. That is the most important thing the Democrats can do – not just hold the House, but make major gains in the Senate, and of course capture the White House. If we oust tRump, we’ll get President Pence – think about that. We need to lean on the Democrats to put forth genuine Progressives as candidates, not corporate-owned fakes. We need to get out the youth vote – drag them to places they can register, by their ears if necessary, and then make sure they actually vote!

  5. Sounds like a good idea to me.  I do not think Dumpy will be impeached, but we need to honor the constitution by pressing for it.  IF, somehow this gets to a senate vote, and he is removed, (yeah, right !) Pence will have virtually no time left to screw things up still more.

  6. I would be delighted if they would honestly start the procedure to impeach tRump. It’s long over due. We’ve suffered enough of this farce of a leader.

    Call it a preliminary probe into starting procedures to impeach, I don’t care. Just keep the momentum and the pressure on Trump and his cronies. The least Democrats can do is to give Trump the sense that he can’t get away with it.

I agree with Lona — keep the pressure on Trump by whatever name you want to call it.  But for actual impeachment, we already know that Moscow Mitch aka McTurtle will never let it on the floor of the Senate.  If he is forced to bring it to the Senate, it will be DOA because Republicans will march in lockstep to support One Term Donnie.  Not only that, impeach now and Dems may actually rile Trump’s base which is not needed right now.
